By accessing, browsing, or using this website/application ("the Service"), you irrevocably and unconditionally accept and agree to be bound by all terms, conditions, disclaimers, and limitations set forth in this document. If you do not agree to these terms in their entirety, you must immediately cease all use of this Service. Continued use constitutes your explicit acceptance of these terms as legally binding.

1. LEGAL STATUS AND NON-AFFILIATION DECLARATION

1.1. Independent Information Service

Kotipathi Lottery Results ("Kotipathi," "the Service," "we," "us," or "our") is an independent, privately developed information aggregation and dissemination service. We hereby explicitly and categorically declare that:

(a) We are NOT affiliated with, endorsed by, sponsored by, or officially connected to the Development Lotteries Board (DLB) established under the Development Lotteries Board Act, No. 20 of 1997, or the National Lotteries Board (NLB) established under the National Lotteries Board Act, or any other lottery operator, gaming authority, or government entity in Sri Lanka or any other jurisdiction.

(b) We are NOT authorized to conduct, operate, promote, or facilitate any lottery, gaming, or gambling activities as defined under the Lotteries Ordinance, Betting and Gaming Levy Act No. 40 of 1983 (as amended), Gaming Ordinance No. 17 of 1889 (as amended), Casino Business (Regulation) Act No. 17 of 2010, or any other applicable gaming legislation.

(c) We do NOT sell lottery tickets, accept wagers, process betting transactions, or facilitate any form of gambling or gaming activities whatsoever.

(d) We are NOT a licensed operator under any gambling, betting, gaming, or lottery legislation in Sri Lanka or any other jurisdiction.

(e) Any representation, express or implied, suggesting official connection with governmental entities, lottery boards, or regulatory authorities is unauthorized, invalid, and contrary to our express declarations.

1.2. Jurisdictional Compliance

This Service operates as an information platform subject to the laws of the Democratic Socialist Republic of Sri Lanka. Users accessing this Service from other jurisdictions do so at their own initiative and are solely responsible for compliance with local laws and regulations applicable in their jurisdiction.

2. NATURE OF INFORMATION PROVIDED

2.1. Information Sources and Accuracy

All lottery results, statistics, historical data, and related information displayed on this Service are:

(a) Sourced from publicly available data published by the Development Lotteries Board (www.dlb.lk) and National Lotteries Board (www.nlb.lk) and other publicly accessible sources.

(b) Provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied, of any kind.

(c) Subject to potential delays, inaccuracies, errors, omissions, technical failures, data corruption, transmission errors, or other deficiencies beyond our control.

(d) NOT official results and do NOT constitute official confirmation of any lottery draw, winning numbers, prize amounts, or eligibility for any prize or payment.

(e) Aggregated and displayed through automated systems which may be subject to technical errors, software bugs, or system malfunctions.

2.2. Predictions, Statistical Analyses, and Algorithmic Content

CRITICAL DISCLAIMER ON PREDICTIVE CONTENT:

Any predictions, pattern analyses, statistical computations, probability calculations, trend analyses, "hot and cold" numbers, frequency distributions, or similar predictive or analytical content provided through this Service are:

(a) Based solely on historical data and mathematical algorithms and do NOT predict, guarantee, or influence future lottery draw outcomes in any manner whatsoever.

(b) Provided exclusively for informational, educational, and entertainment purposes and should NOT be relied upon for any financial, investment, or gambling decisions.

(c) Subject to the fundamental principle that lottery draws are random events, and past performance, patterns, or statistical analyses have NO bearing on future outcomes.

(d) NOT professional advice of any kind, including but not limited to financial advice, investment advice, gambling advice, or professional consultation.

(e) Potentially misleading if interpreted as having predictive value or accuracy regarding future lottery outcomes.

WE EXPLICITLY DISCLAIM ANY AND ALL RESPONSIBILITY FOR FINANCIAL LOSSES, DAMAGES, OR ADVERSE CONSEQUENCES arising from reliance on predictive content, statistical analyses, or any other information provided through this Service.

2.3. Mandatory Verification Requirement

MANDATORY USER OBLIGATION:

Users MUST verify all lottery results, winning numbers, draw information, and any other data through official channels maintained by the Development Lotteries Board (www.dlb.lk), National Lotteries Board (www.nlb.lk), or authorized lottery retailers before making any claims, decisions, or taking any action based on information displayed on this Service. Information on this Service does NOT constitute official verification and should NEVER be solely relied upon for prize claims or financial decisions.

3. COMPREHENSIVE LIMITATION OF LIABILITY

3.1. General Liability Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, including but not limited to the Consumer Affairs Authority Act No. 9 of 2003, Kotipathi Lottery Results, its owners, operators, developers, employees, contractors, affiliates, partners, licensors, and any related entities (collectively, "the Released Parties") EXPRESSLY DISCLAIM ALL LIABILITY for:

(a) Any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of or inability to use this Service.

(b) Financial losses, missed opportunities, lost profits, or economic damages of any nature resulting from reliance on information, predictions, or analyses provided through this Service.

(c) Errors, inaccuracies, omissions, delays, or deficiencies in lottery results, statistics, or any other information displayed on this Service.

(d) Technical failures, system malfunctions, service interruptions, data breaches, security incidents, or unauthorized access to user data or systems.

(e) Actions taken or decisions made based on information, content, or functionality provided through this Service.

(f) Damages arising from computer viruses, malware, cyberattacks, or other technological hazards that may be transmitted through this Service.

(g) Third-party content, advertisements, links, or external services accessed through this Service.

(h) Unauthorized use or disclosure of personal information or data, subject to applicable data protection laws.

3.2. Maximum Liability Cap

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY of the Released Parties for all damages, losses, and causes of action (whether in contract, tort including negligence, or otherwise) exceed the amount of One Hundred Sri Lankan Rupees (LKR 100.00) or the equivalent of One United States Dollar (USD $1.00), whichever is less. This limitation applies regardless of the legal theory upon which any claim is based.

3.3. No Warranty

THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," and "WITH ALL FAULTS." The Released Parties make NO WARRANTIES, EXPRESS OR IMPLIED, including but not limited to:

(a) Warranties of merchantability, fitness for a particular purpose, or non-infringement.

(b) Warranties regarding accuracy, completeness, reliability, or timeliness of information.

(d) Warranties that defects or errors will be corrected or that the Service will meet your requirements.

4. INTELLECTUAL PROPERTY RIGHTS AND DATA USAGE

4.1. Copyright and Proprietary Rights

All content, design elements, software code, databases, user interfaces, graphics, logos, text, and other materials on this Service (excluding publicly available lottery data) are protected by:

(a) Copyright laws under the Code of Intellectual Property Act No. 52 of 1979 (as amended) and international copyright treaties to which Sri Lanka is a party.

(b) Database rights and compilation copyrights applicable to the organization and presentation of information.

(d) Trade secret and proprietary information protections for algorithms, methodologies, and technical implementations.

4.2. Prohibited Uses

Users are STRICTLY PROHIBITED from:

(a) Reproducing, distributing, modifying, creating derivative works from, publicly displaying, publicly performing, republishing, downloading, storing, or transmitting any content from this Service without express written permission.

(b) Data scraping, web scraping, data mining, robotic data extraction, automated data collection, or use of automated systems to access or extract data from this Service, in violation of Computer Crimes Act No. 24 of 2007.

(c) Reverse engineering, decompiling, disassembling, or attempting to derive source code from any software or algorithms used in this Service.

(d) Using content for commercial purposes, including but not limited to operation of competing services, commercial redistribution, or sale of data, without explicit written authorization.

(e) Removing, altering, or obscuring any copyright notices, trademarks, or proprietary rights notices displayed on this Service.

(f) Framing, mirroring, or otherwise incorporating any portion of this Service into any other website, application, or service without authorization.

4.3. Third-Party Intellectual Property

Trademarks, service marks, and trade names of lottery operators, government entities, and third parties used on this Service are used under fair use principles for factual reporting and informational purposes only. Such use does NOT imply affiliation, endorsement, or sponsorship. All third-party intellectual property rights are acknowledged and respected.

5. DATA PROTECTION AND PRIVACY COMPLIANCE

5.1. Personal Data Protection Act Compliance

This Service processes personal data in compliance with the Personal Data Protection Act No. 9 of 2022 ("PDPA") and applicable data protection regulations. As required under the PDPA:

(a) We act as a data controller for personal information collected through this Service and implement appropriate technical and organizational measures to ensure data security.

(b) Personal data is processed only for specified, explicit, and legitimate purposes in accordance with PDPA principles of legitimacy, proportionality, and transparency.

(c) Users have rights under the PDPA including rights of access, rectification, erasure, and objection to processing, subject to applicable exceptions and limitations.

(d) We implement data protection management programs and internal controls as required under PDPA compliance obligations.

(e) In the event of a data breach affecting personal data, we will notify the Data Protection Authority of Sri Lanka as required under PDPA regulations.

5.2. Data Collection and Usage Transparency

Detailed information about our data collection, processing, storage, and sharing practices is available in our Privacy Policy. By using this Service, you acknowledge and consent to data processing activities described in the Privacy Policy, subject to your rights under applicable data protection laws.

5.3. Electronic Communications

In accordance with Part IV of the PDPA regarding use of personal data for solicited messaging, we will only send electronic communications for promotional or marketing purposes with your explicit consent, and you may withdraw such consent at any time.

6. CYBERSECURITY AND TECHNICAL PROTECTIONS

6.1. Computer Crimes Act Compliance

Users agree to comply with all provisions of the Computer Crimes Act No. 24 of 2007 and specifically agree NOT to:

(a) Secure or attempt to secure unauthorized access to this Service's computer systems, networks, databases, or data (Sections 3 & 4 of Computer Crimes Act).

(b) Cause computers to perform functions without lawful authority that result in unauthorized modification, damage, or potential damage to computer systems or data (Section 5).

(c) Perform denial-of-service attacks, introduce viruses, malware, logic bombs, trojan horses, or other harmful computer programs (Section 6).

(d) Unlawfully intercept computer data, communications, or electromagnetic emissions from computer systems (Section 8).

(e) Unlawfully disclose passwords, access codes, authentication credentials, or security procedures (Section 10).

(f) Engage in any activity that poses threats to national security, public order, or economic stability through computer systems.

6.2. Security Limitations

While we implement commercially reasonable security measures, we CANNOT guarantee absolute security. Users acknowledge that:

(a) No method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute protection against cyber threats.

(b) Users are responsible for maintaining the security of their own devices, internet connections, and access credentials.

(c) We are not liable for damages resulting from unauthorized access, data breaches, or security incidents beyond our reasonable control.

7. TELECOMMUNICATIONS AND ELECTRONIC TRANSACTIONS

7.1. Electronic Transactions Act Recognition

This Service operates in accordance with the Electronic Transactions Act No. 19 of 2006 (as amended by Act No. 25 of 2017), which provides legal recognition to electronic records, electronic signatures, and electronic contracts under Sri Lankan law.

7.2. Telecommunications Compliance

This Service complies with applicable provisions of the Sri Lanka Telecommunications Act No. 25 of 1991 (as amended) and regulations promulgated by the Telecommunications Regulatory Commission of Sri Lanka (TRCSL). Users agree to comply with all applicable telecommunications regulations when accessing this Service.

7.3. Electronic Communication Terms

By using this Service, you consent to receive electronic communications from us. These electronic communications may include notices, disclosures, and other information concerning or related to the Service and are deemed to satisfy any legal requirement that such communications be in writing.

8. SERVICE AVAILABILITY AND TECHNICAL LIMITATIONS

8.1. Service Availability Disclaimer

We do NOT guarantee that:

(a) The Service will be available continuously, uninterruptedly, or without delays, disruptions, or technical failures.

(b) The Service will be free from errors, bugs, defects, viruses, or other harmful components.

(d) Server downtime, maintenance activities, or technical upgrades will not interrupt service access.

8.2. Right to Modify or Discontinue

We reserve the absolute right to modify, suspend, discontinue, or terminate the Service or any feature thereof at any time, temporarily or permanently, with or without notice, for any reason or no reason, without incurring any liability to users or third parties.

8.3. Third-Party Service Dependencies

This Service may depend on third-party infrastructure, hosting services, content delivery networks, or data sources. We are not responsible for failures, interruptions, or deficiencies attributable to third-party service providers.

9. USER CONDUCT AND ACCEPTABLE USE POLICY

9.1. Prohibited Conduct

Users MUST NOT:

(a) Use the Service for any unlawful purpose or in violation of any local, state, national, or international law or regulation.

(b) Engage in any conduct that restricts, inhibits, or prevents any other user from using or enjoying the Service.

(c) Transmit or upload viruses, worms, trojan horses, malware, or any malicious code designed to interrupt, destroy, or limit functionality.

(d) Attempt to gain unauthorized access to systems, networks, servers, or accounts connected to the Service.

(e) Interfere with or disrupt the Service, servers, networks, or security measures.

(f) Impersonate any person or entity or falsely state or misrepresent affiliation with any person or entity.

(g) Use automated systems (bots, scripts, spiders) to access the Service except as permitted by robots.txt.

(h) Collect or harvest personal information of other users without authorization.

(i) Use the Service to transmit spam, unsolicited advertising, or promotional materials.

9.2. Enforcement and Termination

We reserve the right to investigate suspected violations of these terms, cooperate with law enforcement authorities, and terminate or suspend access to the Service for users who violate these terms, without notice and without liability.

10. AGE RESTRICTIONS AND RESPONSIBLE USE

10.1. Minimum Age Requirement

This Service is intended for use by individuals who have attained the age of eighteen (18) years or the legal age of majority in their jurisdiction, whichever is greater. By using this Service, you represent and warrant that you meet the applicable age requirements. We do not knowingly collect personal information from individuals below the minimum age requirement.

10.2. Responsible Gaming Advocacy

RESPONSIBLE GAMING MESSAGE:

We advocate for responsible gaming practices. Lottery participation should be viewed as entertainment, not as a financial strategy, income source, or solution to economic problems. If you or someone you know exhibits signs of problem gambling or gambling addiction, please seek professional help. Resources are available through mental health services, counseling centers, and gambling addiction support organizations in Sri Lanka.

10.3. Financial Responsibility

Users should only participate in lotteries with funds they can afford to lose and should never gamble with money needed for essential expenses such as housing, food, education, healthcare, or debt obligations. Never borrow money or use credit facilities to purchase lottery tickets.

11. THIRD-PARTY LINKS AND EXTERNAL RESOURCES

11.1. Third-Party Website Disclaimer

This Service may contain hyperlinks to third-party websites, resources, or services that are not owned, controlled, operated, or maintained by us. We provide these links solely for user convenience and informational purposes. The inclusion of any link does NOT imply our endorsement, approval, or recommendation of the linked website or its content, products, services, or operators.

11.2. No Responsibility for Third-Party Content

We have NO CONTROL over and assume NO RESPONSIBILITY for:

(a) The content, accuracy, legality, appropriateness, functionality, privacy policies, terms of service, or practices of any third-party websites or services.

(b) Any damages, losses, or adverse consequences arising from access to or use of third-party websites or reliance on third-party content, goods, or services.

(d) Data collection, privacy practices, or security measures employed by third-party websites.

Users access third-party websites at their own risk and should review the terms of service and privacy policies of any third-party websites they visit.

12. INDEMNIFICATION

12.1. User Indemnification Obligation

You agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees and legal costs) arising from or relating to:

(a) Your use of or inability to use the Service.

(b) Your violation of these Terms of Use or any applicable laws or regulations.

(c) Your violation of any rights of third parties, including intellectual property rights, privacy rights, or publicity rights.

(d) Any content you submit, post, transmit, or make available through the Service.

(e) Unauthorized use of your account or access credentials.

(f) Any fraudulent, deceptive, or illegal activity conducted through your use of the Service.

12.2. Defense Cooperation

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims. You may not settle any claim without our prior written consent.

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1. Applicable Law

These Terms of Use, this Disclaimer, and all related disputes, claims, or controversies shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions. Applicable laws include but are not limited to:

• National Lotteries Board Act

• Lotteries Ordinance

• Personal Data Protection Act No. 9 of 2022

• Consumer Affairs Authority Act No. 9 of 2003

• Electronic Transactions Act No. 19 of 2006 (as amended)

• Computer Crimes Act No. 24 of 2007

• Telecommunications Act No. 25 of 1991 (as amended)

• Code of Intellectual Property Act No. 52 of 1979 (as amended)

• All applicable regulations, directives, and subsidiary legislation

13.2. Exclusive Jurisdiction

Any legal action, suit, or proceeding arising out of or relating to these Terms of Use or the Service shall be instituted EXCLUSIVELY in the courts located in Colombo, Democratic Socialist Republic of Sri Lanka. You irrevocably submit to the exclusive jurisdiction of such courts and waive any objection to venue or inconvenient forum.

13.3. Dispute Resolution Process

Before initiating formal legal proceedings, parties agree to attempt good-faith negotiation to resolve disputes. If negotiation fails within thirty (30) days, parties may pursue available legal remedies in Sri Lankan courts.

13.4. Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class action, consolidated action, or representative action. You waive any right to participate in class action litigation or class-wide arbitration.

14. MODIFICATIONS AND UPDATES TO TERMS

14.1. Right to Modify

We reserve the absolute right to modify, amend, update, or replace these Terms of Use, this Disclaimer, or any policy at any time, in our sole discretion, with or without advance notice. Modifications become effective immediately upon posting to this Service unless otherwise specified.

14.2. Continued Use Constitutes Acceptance

Your continued use of the Service following the posting of modifications constitutes your acceptance of and agreement to be bound by such modifications. It is your responsibility to review these Terms periodically for changes. If you do not agree to modified terms, you must immediately cease using the Service.

14.3. Version Control

The "Last Updated" date at the top of this document indicates when these Terms were last revised. We recommend checking this date periodically to determine if updates have been made.

15. SEVERABILITY AND WAIVER

15.1. Severability

If any provision of these Terms is held to be invalid, illegal, unenforceable, or in conflict with applicable law by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable while preserving the original intent.

15.2. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision or any other right or provision. No waiver shall be effective unless in writing and signed by an authorized representative.

15.3. Survival

Provisions that by their nature should survive termination of these Terms shall survive, including but not limited to limitations of liability, indemnification obligations, intellectual property rights, dispute resolution terms, and governing law provisions.

16. ENTIRE AGREEMENT

These Terms of Use, together with our Privacy Policy and any other legal notices or policies published on this Service, constitute the entire agreement between you and Kotipathi Lottery Results regarding the use of this Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

17. REGULATORY COMPLIANCE AND AUTHORITY COOPERATION

17.1. Regulatory Cooperation

We commit to full cooperation with regulatory authorities including but not limited to:

• Development Lotteries Board (DLB)

• National Lotteries Board (NLB)

• Data Protection Authority of Sri Lanka

• Consumer Affairs Authority (CAA)

• Telecommunications Regulatory Commission of Sri Lanka (TRCSL)

• Computer Emergency Readiness Team (CERT)

• Sri Lanka Police - Cyber Crime Investigation Division

• Any other relevant governmental or regulatory body

17.2. Compliance Reporting

We will promptly comply with lawful requests for information, cooperation in investigations, and directives from competent authorities in accordance with applicable laws and legal procedures.

18. FORCE MAJEURE

We shall not be liable for any failure or delay in performance of the Service resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, pandemics, epidemics, strikes, labor disputes, telecommunications failures, internet service provider failures, power outages, government actions, court orders, or any other force majeure events.

(3) You accept full responsibility for verifying all information through official channels before making any decisions or taking any actions.
